Y Communications User Agreement

Please read this agreement carefully before using Y Communicator.

Welcome to Y Communications! Y Communications is a company that builds technologies and services that enables people to private communications through end-to-end encrypted technology with post-quantum cryptography. This User Agreement sets forth the terms of use. If you do not agree to these Terms, then do not access or use Y Communications and its services.

This is a User Agreement between you (also referred to herein as "User" or "Customer" or "Your") and Y Communications, Inc. ("Y Communications", "we", "us", and "our.") This User Agreement ("Agreement" or "User Agreement") governs your use of the communications platform provided by Y Communications described below and any other such services as may be offered by Y Communications from time to time. By signing up for the use of Y Communications Account, downloading the Y Communications Application, and/or the use of the Y Communications software, you agree that you have read, understand and accept all of the terms and conditions contained in this Agreement.

Amendment of these Terms

We may amend or modify this Agreement at any time by posting the revised agreement on the Y Communications website. Any such modified terms shall be known as "Revised User Agreement." Since Y Communications does not collect, store, or otherwise keep any user data, no copy can be provided to you. The Revised Agreement shall be effective as of the time it is posted but will not apply retroactively. Your continued use of Y Communications after the posting of a Revised Agreement constitutes your acceptance of any Revised Agreement. If you do not agree with any such modification, your sole and exclusive remedy is to terminate your use of Y Communication Services and/or cessation of the use of the Y Communications application.

Y Communications Use Eligibility

To be eligible to use Y Communications, you must be at least 18 years of age. By using Y Communications, you represent and warrant that you meet this age requirement.

Geographic Restrictions

There are certain features which may or may not be available to you depending on your location and other criteria. This app is currently not available in France and may not be available in all countries at this time.

Creation of Y Communications Account

You will also complete certain procedures before you are permitted to use Y Communications, including agreeing to these terms and conditions. By registering, downloading, and/or using Y Communications, you agree and represent that you have access to Y Communications software and that your use of the software will only be for yourself and not on behalf of a third party, unless you have obtained prior written approval from Y Communications. You are fully responsible for all activity that occurs through your use of Y Communications.

Y Communications Access

Although we strive to provide you with excellent service, we do not represent that Y Communications will be available without interruption and do not guarantee access to Y Communications services. Y Communications is built so that your conversations live on your devices as opposed to Y Communication servers. Y Communications messages are delivered over a zero-trust, RAM-only relay network that cannot read, store, link, decrypt, or otherwise have access to your messages. Y Communications does require the user to have sufficient network access and reliable connections in order to transmit messages. Y Communications shall not be liable for any damages that may arise from any users disruption in access to the Y Communications software.

Indemnification Policy

If you have a dispute between one or more users of Y Communications, you hereby release Y Communications, its affiliates, service providers, and each of their respective officers, directors, agents, joint venturers, employees, and representatives from any and all claims, demands, and damages (actual and consequential) of every kind and nature arising out of or in any way connected to such disputes. You agree to indemnify Y Communications and hold Y Communications harmless from any claim or demand, including attorney's fees, fines, fees, or penalties imposed by any regulatory authority, arising out of (or related to) your breach of these use terms, or your violation of any law, rule, or regulation, or the rights of any third party.

Limitation of Liability

IN NO EVENT SHALL Y COMMUNICATIONS, ITS AFFILIATES, SERVICE PROVIDERS, OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, AGENTS, JOINT VENTURERS, EMPLOYEES, OR REPRESENTATIVES BE LIABLE FOR ANY LOSS OF DATA, DIMINUTION OF BUSINESS OPPORTUNITY, DATA CORRUPTION, BREACH OF DATA, OR ANY OTHER SPECIAL, INCIDENTAL, DIRECT, OR CONSEQUENTIAL DAMAGE, WHETHER ARISING OUT OF CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, ARISING OUT OF, OR IN CONNECTION WITH, ANY USE OF THE Y COMMUNICATIONS SOFTWARE OR Y COMMUNICATION SERVICES.

No Warranty

Y Communications and its related services are provided on an "As is" and "As Available" basis without any representation or warranty. To the maximum extent permitted by applicable law, Y Communications disclaims any implied warranty of merchantability or fitness for a particular purpose. Y Communications does not make any representations or warranties that access to the Y Communications software will be continuous, uninterrupted, timely, or error free. Y Communications does not guarantee that all messages will be transmitted upon the immediate execution and sending of any message. You hereby acknowledge that you have not relied upon any other statement or understanding, whether written or oral, with respect to your use and access to Y Communications and accept that Y Communications will not be liable for any losses or damages arising out of an interrupted transmission, loss of data, software glitches, software bugs, or other like error.

Non-Waiver of Rights

This Agreement shall not be construed to waive rights that cannot be waived under applicable laws. In addition, our failure to insist upon or enforce strict performance by you of any provision of this Agreement, or to exercise any right under this Agreement, shall not be construed as a waiver or relinquishment of any of our rights.

Hardware and Software Requirements

In order to access and utilize Y Communications you will need the following:

iOS: iOS 17.6 or later on an iPhone, iPad, or iPod touch
Android: Android 10 (API 29) or later with an ARM64 or x86_64 processor and at least 80 MB of free storage
Network: A reliable internet connection is required to send and receive messages
